Terms and Conditions of Service
1. Acceptance of Terms
The following is a legal agreement between you ("Client" or "Purchaser") and jm photographics, llc ("Agency"). By accessing www.jmphotographics.com, commissioning services, or accessing digital galleries, you agree to be bound by these Terms and Conditions and all applicable laws and regulations.
2. Intellectual Property & Copyright
All images, video, layouts, and digital products created by jm photographics are the sole property of the Agency and are protected by United States Copyright Laws (USC Title 17).
Ownership: Commissioning a service does not constitute a transfer of copyright.
Waiver: Clients waive any claims for editorial control or ownership unless a specific Copyright Transfer Agreement is executed in writing and signed by Jason R. Meek.
3. Usage License
Upon full payment of the service fee, the Client is granted a Limited Usage License.
Scope: Images/Products are for the Client's internal or promotional use as defined in the specific project proposal.
Restrictions: You may not redistribute, resell, or sub-license Agency assets to third parties. Modifications or "dissections" of the work of jm photographics for the purpose of creating derivative products for resale are strictly prohibited.
4. Digital Asset Delivery & Installation
Assets delivered via the Client Portal or digital download are intended for installation on devices owned directly by the Client.
Redistribution: Sharing Agency-developed templates or "Action Sets" with non-contracted photographers, relatives, or third-party organizations is a violation of this license.
5. Refund & Return Policy
Due to the custom nature of professional photography and the immediate delivery of digital assets, all services and products are non-refundable and non-returnable.
Service Retainers: Booking fees and deposits are required to secure dates and are non-refundable, as they represent the reservation of the Agency’s 27-year expertise and availability.
6. Archive & Replacement Policy
Clients are responsible for the long-term storage and backup of their delivered assets.
Support: While the Agency maintains a secondary archive of most projects, we are not a permanent storage service.
Recovery Fees: Requests to recover lost assets from the jm photographics archives after a computer failure or loss may incur a research and retrieval fee. Verification of the original purchase (date, email, and receipt) is required.
7. Disclaimer of Warranties
All services and digital assets are provided "As Is." jm photographics offers no warranty, explicit or implied, regarding the longevity of digital media, future compatibility of file types, or uninterrupted website access. We are not liable for any incidental or consequential damages, including lost profits, arising from the use of our assets or website.
8. Communication Consent
By creating a Client Portal account or commissioning services, you agree to receive project updates and our professional newsletter. You may opt out of marketing communications at any time via the "Unsubscribe" link in our correspondence.
